Terms of Service
The rules and guidelines for using businesscardX.

These Terms of Service ("Terms") govern your access to and use of the website, web application, NFC business cards, and related services (collectively, the "Services") provided by businesscardX ("we", "us", "our"), a Canadian company based in Toronto, Ontario.
By creating an account, purchasing a product, or using our Services, you agree to be bound by these Terms. If you do not agree, do not use our Services.
1. Eligibility
You must be at least 16 years of age to use our Services. By using the Services, you represent that you meet this requirement and that the information you provide is accurate and complete.
2. Account Registration
- You must create an account to access most features of the Services.
- You are responsible for maintaining the confidentiality of your login credentials.
- You are responsible for all activity that occurs under your account.
- You must provide accurate, current, and complete information during registration and keep it updated.
- You may not create more than one account per person. ELITE team accounts are managed by an administrator.
- We reserve the right to suspend or terminate accounts that violate these Terms.
3. Products and Services
3.1 NFC Business Cards
We sell physical NFC business cards that link to a digital profile hosted on our platform. Each card is:
- Custom printed with your name and company (or second line of text) in gold or silver foil on a matte black card
- Embedded with an NFC chip and QR code that links to your digital profile
- Personalized and made-to-order — cards cannot be returned or exchanged once printed (see our Refund Policy for exceptions)
3.2 Digital Profile
Your digital profile is a web page displaying your contact information, photo, social links, bio, and other details you choose to share. Your profile is publicly accessible via its URL. You are solely responsible for the content you publish on your profile.
3.3 Subscription Plans
Access to the Services requires an active subscription:
- PRO — For individuals. Includes 1 NFC card, digital profile, CRM, analytics, and all premium features.
- ELITE — For teams (minimum 2 users). Includes NFC cards for all team members, admin dashboard, custom branding, and all PRO features.
Subscriptions are billed monthly or annually through Shopify. Pricing is in Canadian dollars (CAD) and is listed on our pricing page. We reserve the right to change pricing with 30 days' notice to existing subscribers.
3.4 Free Trial
We may offer a 30-day free trial for monthly subscriptions. A valid payment method is required to start a trial. If you do not cancel before the trial ends, your subscription will automatically convert to a paid monthly plan. Your NFC card is printed and shipped during the trial period.
3.5 Premium Tokens
Certain features (AI email signature generation, AI business card scanning, SMS follow-ups, profile translation) consume tokens. Subscribers receive a monthly token allowance that refills on the 1st of each month. Additional token packs may be purchased separately. Unused tokens do not roll over. Tokens have no cash value and are non-refundable.
4. Payment and Billing
- All payments are processed securely by Shopify Payments.
- Subscriptions automatically renew at the end of each billing cycle unless cancelled.
- Shipping fees are charged at the time of purchase and are non-refundable.
- You are responsible for keeping your payment method current. If a payment fails, we may suspend your account until payment is resolved.
- All prices are in Canadian dollars (CAD) and exclude applicable taxes, which are calculated at checkout.
5. Acceptable Use
You agree not to use the Services to:
- Publish content that is illegal, defamatory, threatening, harassing, obscene, or otherwise objectionable
- Impersonate another person or entity
- Upload malware, viruses, or any harmful code
- Distribute spam, phishing content, or unsolicited bulk messages through follow-up features
- Scrape, crawl, or extract data from our platform without authorization
- Interfere with or disrupt the Services or servers
- Use the Services for any purpose that violates applicable law
- Share your account credentials with others (ELITE administrators may manage team access through the admin portal)
We reserve the right to remove content and suspend accounts that violate these rules, without prior notice.
6. User Content
- You retain ownership of all content you upload to the Services (photos, text, media, logos).
- By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to host, display, and distribute that content as necessary to provide the Services (e.g., displaying your profile to visitors, generating your NFC card, embedding in email signatures).
- You represent that you have the right to upload and share any content you provide, and that it does not infringe on any third party's intellectual property or privacy rights.
- We do not claim ownership of your content and will not use it for advertising or marketing purposes without your explicit consent.
7. Intellectual Property
The businesscardX name, logo, website design, and all related trademarks, service marks, and trade dress are the property of businesscardX. You may not use our branding without prior written permission.
The underlying technology, code, and design of the Services are owned by businesscardX and protected by intellectual property laws.
8. Third-Party Services and Integrations
The Services integrate with third-party platforms (Google, HubSpot, Zapier, Gmail, Outlook). Your use of these integrations is subject to the respective third party's terms of service and privacy policies. We are not responsible for the practices of third-party services.
9. Cancellation and Termination
- You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period — you retain access until then.
- Upon cancellation, your digital profile will be deactivated and will no longer be accessible via NFC tap or QR scan.
- You may delete your account entirely through the app, which will permanently remove your profile, contacts, and analytics data.
- We may terminate or suspend your account at any time for violation of these Terms, with or without notice.

10. Limitation of Liability
To the maximum extent permitted by law:
- The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied.
- We do not warrant that the Services will be uninterrupted, error-free, or secure.
- We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services.
- Our total liability for any claim arising from the Services shall not exceed the amount you paid us in the 12 months preceding the claim.
- We are not responsible for any loss of business, reputation, or opportunities resulting from the use or inability to use the Services.
11. Indemnification
You agree to indemnify and hold harmless businesscardX, its officers, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Services, your violation of these Terms, or your violation of any third party's rights.
12. Dispute Resolution
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from or relating to these Terms or the Services shall be resolved in the courts of Ontario, Canada. Before initiating formal proceedings, both parties agree to attempt to resolve disputes in good faith through direct communication.
13. Changes to These Terms
We may update these Terms from time to time. The updated version will be indicated by the "Last updated" date. We will notify active subscribers of material changes via email. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
14. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
